European integration of Ukraine

I explore six possible scenarios—options and strategies for the development of Ukraine’s (as well as, to a lesser degree, Georgia's and Moldova’s) security situation during the coming five to 15 years. As long as Russia’s current regime continues to exist, Moscow’s aggressive stance towards Kyiv will probably last, and Ukraine has no easy way to achieve international organizational embeddedness, as detailed below. The scenarios are: (1) thecontinuation of the current “gray zone” status of Kyiv, Chisinau, and Tbilisi (the capitals of Ukraine, Moldova, and Georgia, respectively); (2) Ukraine and Georgia’s permanent neutrality as a result of some Western-Russian bargain; (3) Ukraine, Moldova, and Georgia’s accession to the EU; (4) Ukraine and Georgia’s entry into NATO; (5) Ukraine and Georgia’s Major Non-NATO Ally status with the United States; and (6) the creation of an Intermarium (“land between the seas”) coalition of East-Central European NATO member states on the one hand, and post-Soviet non-NATO countries (Ukraine, Georgia, Moldova, and perhaps Azerbaijan) on the other. These six scenarios for Ukraine’s foreign affairs may or may not materialize in the foreseeable future and vary in terms of likelihood that they will occur; they would demand very different approaches and would have highly diverging implications for both Ukrainian and non-Ukrainian actors in Eastern Europe.

The focus of this paper is twofold. On the one hand, it outlines the geopolitical rationale behind contemporary Russian expansionism, as well as presents the asymmetric mechanisms utilized by Russia to solidify its authority in the post-communist space. The four commonly used theoretical frameworks explaining Russian expansionism were described and critically assessed. Apart from this, the Russian and foreign political philosophic thought of the 19-21 centuries was referred to, to trace the evolution of the Russian Byzantium-type governing tradition and national identity. On the other hand, the paper assesses the features of post-colonial Ukrainian political culture and unveils premises for the emergence of its statehood in the 1990s. The major differences between Russian and Ukrainian political cultures and identities are emphasized. Finally, the hypothesis tested is that a democratic Ukraine – strengthened by cooperation with its Western allies – will become an obstacle of Russian expansionism in the future.

This book aims to uncover and assess changes in the EU's foreign policy towards Ukraine in the times of wide-scale social protests in Kyiv. To accomplish this task, this book enlists and analyses documents, agreements, and treaties which establish the frameworks for EU-Ukraine cooperation. It also identifies the interests of lobbying groups in Brussels. Finally, it describes the impact of the regional balance of powers on EU-Ukraine relations.
This book attempts to specify the nature and structures of drivers behind the EU policy towards Ukraine, as well as uncover the place of human rights in these structures. Based on cases from the Orange Revolution, Tax Maidan, and Euromaidan, the book tests a hypothesis that the wide-scale violations of the right for assembly are enough to downplay the preeminence of the EU's economic objectives. If such violations happen, decision-makers in Brussels switch into the "crisis" management mode on the expense of exploring business opportunities.

Ни один из этих шести сценариев не обнадеживает. Первый, о сохранении «серой зоны», сегодня кажется наиболее вероятным. Но он, возможно, с учетом известного прошлого опыта, в конечном счете – тупиковый. Остается неясным, может ли даже более сильная чем сегодня ассоциация с Западом, адаптация к новым вызвам после 2014-го года и консолидация постмайдановского украинского государства в рамках этого сценария заменить или компенсировать официальную и устойчивую институциональную интеграцию Украины, Грузии и Молдовы в более или менее значимую международную коалицию до такой степени, что безопасность этих трех стран существенно усилится.
Остальные пять сценариев, напротив, дают некоторые международно-правовые механизмы серьезного обеспечения безопасности в сегодняшней «серой зоне». Они бы принципиально поменяли всю геополитику Восточной Европы путем подписания разного рода новых больших договоров. Но эти сценарии, которые в тех иди иных измерениях выгодны Украине, Грузии и, частично, Молдове, сегодня мало реалистичны, если не фантастичны. Тем не менее, эти пять сценариев в той или иной мере могут стать возможными в будущем, если произойдут существенные изменения во внутренней или внешней политике тех или иных вовлеченных в восточноевропейский регион стран и организаций.

Дещо подібно до подій після 1918 року в Центрально-Східній Европі від 1991 року ідея Інтермаріюму також перебуває в сфері дискусій, спекуляцій і прокламацій. Як наслідок, незалученість країн «сірої зони» до значущих безпекових об’єднань залишає низькими ризики та затрати військової інтервенції Росії в Грузію, Молдову чи Україну. Навіть після доленосних подій 2014 року вибудування коаліцій у Східній Европі не просунулося. Три держави Східного партнерства тепер отримують певну політичну, економічну і військову підтримку від НАТО й ЕС. Однак загалом вони все-таки перебувають сам на сам у військовій конфронтації з Кремлем. Уроки і міжвоєнного, і раннього пострадянського періодів показують: така ситуація не є сталою для міжнарод- них відносин у Східній Европі.

As the European Union (EU) and the North Atlantic Treaty Organization (NATO), and their member states become increasingly absorbed by internal challenges, the friends of Ukraine need to seek new paths to increase Ukrainian security, resilience and growth before its accession to the West’s two major organizations. An alternative way to reduce Ukraine’s current institutional isolation would be to develop more intense bilateral relations with friendly states across the globe, notably the United States.

Самое главное упущение состоит в том, что глубокая трансформация партийной и избирательной систем Украины не произошла и таким образом функционирование Рады, правительства, госорганов и госпредприятий следует старым «олигархическим» правилам. Возможно, эта реформа была умышленно не предпринята, чтобы не подорвать влияние магнатов.

К настоящему времени важные перемены начаты во многих государственных сферах, были созданы новые правительственные институты и частично изменены некоторые правила игры. Однако, патронажная логика или т.н. «неопатримониализм» (тип организации власти и властных отношений, в котором объединены элементы традиционных патримониальных государств с современными практиками) и, связаны с этим, выраженно театральный характер большей части официальной постсоветской украинской политики, законодательства и административной практики до начала 2018 года принципиально не изменились. В этом решающем отношении постмайданная Украина осталась, по сути, домайданной. Революция достоинства всё ещё ждёт своего совершения.

Деякі з представлених сценаріїв можуть на тлі сьогоднішньої міжнародної ситуації видатися нездійсненними. Проте, їх попереднє обговорення вже сьогодні має сенс на той випадок, якщо у наступні роки відбудуться різкі повороти, наприклад, всередині України, Росії, США та/або Європейського Союзу. Останні роки навчили, що не можна повністю виключати навіть найбільш – здавалося б – неймовірних нових розвитків. Такого роду, з одного боку, політичні катаклізми або ж, з іншого боку, прогресивні стрибки можуть надати нові «вікна можливостей» для України і її друзів. Якщо таке вікно дійсно раптом відкриється – Києву, Брюсселю, Вашингтону та іншим гравцям потрібно буде діяти, можливо, швидко і рішуче, щоб не згаяти історичний момент. Саме на цей випадок, тобто щоб бути готовим і до самого різкого повороту подій, тут обговорюються поки лише гіпотетичні варіанти українського майбутнього. Вони можуть залишитися такими ж фантастичними, якими вони видаються на сьогодні – або ж, навпаки, стати цілком можливими, якщо світ істотно зміниться. Крім продовження сьогоднішнього стану невключеності в значимі міжнародні структури безпеки, Україна має п’ять альтернативних сценаріїв: «фінляндізація», вступ до ЄС, приєднання до НАТО, окремий договір зі США, створення коаліції «Міжмор’я».

As long as the social, political and business climate in Ukraine is marked by fear of more Russian escalation, invasion, occupation, annexation or/and expropriation, a sustainable economic recovery cannot be expected. But Ukraine's state – reformed or not – cannot survive for long without massive domestic and foreign investment. If Russia does not cease its subversion of social stability and state security in Ukraine, even a thoroughly reformed Ukrainian state formally ready for EU accession would be doomed to failure.

Today, an Intermarium could stretch from Narva in the north to Batumi in the south. Significant parts of the populations and the majority of foreign affairs experts of the countries between the Baltic and Black seas view Putin’s Russia today as the biggest risk, a clear threat, and a dangerous enemy. Inside NATO, the political mainstreams of Estonia, Latvia, Lithuania, Poland, and Romania especially regard Russia as a major security problem. The same can be said of Georgia, Ukraine, Azerbaijan, and Moldova outside NATO. These states could thus form the core of an East-Central European-South Caucasian defense coalition. Further European countries within, or close to, the “land between the seas” — from the Scandinavian to the Western Balkan nations — might, for historical or other reasons, be willing to support, join, or associate themselves with such an alliance. With regard to its legal set-up, the above-mentioned 2010 Agreement on Strategic Partnership and Mutual Support between Turkey and Azerbaijan could play the role of a model treaty for a security arrangement between certain eastern NATO states on the one side, and some post-Soviet non-NATO countries on the other. As in Article 2 of the ratified Turkish-Azeri alliance, the exact modus of action, in case of an aggression, could be left open to each Intermarium country. The pact could simply state an obligation that, if confronted with an attack, the parties would “mutually assist each other” and that the “means and extent of this assistance” would be agreed upon ad hoc, once a military infringement has happened.

A new study published by the German Corporation for International Cooperation (GIZ GmbH) in 2018, Ukraine in Germany’s Eyes: Pictures and Perceptions of a Land in Transition, fills that void. The publication, which surveys the views of German experts, provides a revealing documentation of German views on Ukraine today.

4-го грудня 2017 року в приміщенні Українського вільного університету відбулася доповідь «Die künftige internationale Einbettung der Ukraine: sechs sicherheitspolitische Szenarien für einen europäischen Schlüsselstaat» («Майбутня міжнародна інтеграція України: шість політичних сценаріїв безпеки для ключової європейської держави») д-ра Андреаса Умлянда (Dr. Andreas Umland), політолога, наукового співробітника Інституту євроатлантичного співпраці у Києві, редактора книжкової серії «Радянська та пострадянська політика та суспільство» („Soviet and Post-Soviet Politics and Society“), співредактора «Форуму східноєвропейської ідеї та сучасної історії» („Forums für osteuropäische Ideen- und Zeitgeschichte“).

Ukraine’s reform process is delayed by both, domestic enemies and hindrances, as well as various effects of Moscow’s “hybrid war” against Kyiv on the Ukrainian economy, state and society. In view of the enormous dimensions, complications and challenges of the transition agenda, the results that have been achieved until mid-2016 are not trivial. However, they are still far from achieving a sustainable transformation and have partly happened only on paper so far. A successful “Europeanization” of Ukraine could have positive repercussions and further liberal-democratic values throughout the entire post-Soviet region. To make Ukraine’s reforms successful, close cooperation of Ukrainian reform-oriented politicians, civic activists and civil servants with international donor organizations (EU, IMF, EBRD, World Bank etc.) is necessary.

Ukrainian politicians, diplomats, journalists and intellectuals should start paying more attention to how the countries of South-Eastern Europe (SEE) are currently preparing for their entry into the European Union. Kyiv can accelerate its own European integration by entering a number of SEE cooperation formats specifically designed to prepare the Western Balkan states for their future EU membership.

Internationalen Firmen und Märkten muss glaubhaft gemacht werden, dass die Ukraine im Begriff ist, Teil des europäischen Wirtschafts- und Rechtsraumes zu werden. Das könnte geschehen mittels vollständiger Ratifizierung des Assoziierungsabkommens durch alle EU-Mitgliedsländer, Visafreiheit für ukrainische Bürger für Kurzreisen in den Schengenraum, einer bedingten, aber offiziellen EU-Mitgliedschaftsperspektive sowie einer Handels- bzw. Investitionsversicherung, wie wir sie in Deutschland von den Hermes-Bürgschaften kennen. Auch die gezielte Entsendung von Langzeitexperten für Wirtschafts-, Gesundheits-, Bildungs- und Verwaltungsreformen würde der Ukraine helfen. Ein derartiges westliches Maßnahmenpaket - eine Art neuer Marshall-Plan - würde womöglich gar nicht so viel kosten. Eine solche konzertierte Aktion könnte aber die Stimmung in- und ausländischer Investoren verbessern und würde den Ukrainern helfen, sich selbst aus ihrer jetzigen tiefen Wirtschaftskrise herauszuarbeiten.

Protests began in Ukraine in November following the country’s failure to sign an Association Agreement with the European Union. In an interview with EUROPP’s Managing Editor Stuart Brown, Andreas Umland, Associate Professor at National University of Kyiv-Mohyla Academy, discusses the development of the protests, the role the EU should play in the crisis, and the very real threat that the situation could develop into a civil war.

Contrairement à l'image négative dominante dans les reportages occidentaux sur Kyiv, les réformes sociales, politiques et économiques en Ukraine avancent lentement, mais surement. Parmi de nouvelles institutions et de nouveaux règlements, l'Ukraine a mis en place plusieurs agences spécialisées traitant notamment de la prévention, de l'investigation et de la lutte contre la corruption. La nouvelle loi sur les déclarations électroniques concernant le patrimoine des employés du service public a conduit à la publication d'informations sur la richesse de certains députés, déclenchant des débats animés dans la société sur la nature profonde de la classe politique en Ukraine. De multiples réformes sont encouragées et engagées par des activistes et des entrepreneurs patriotes, tant dans la capitale Kyiv que dans les régions ukrainiennes. Ces initiatives sont souvent aidées par les occidentaux. Paradoxalement, les reportages des médias étrangers sur ce sujet sont absents ou bien incomplets – un défaut qui est moins lié au manque de journalistes occidentaux disposant d'une expertise suffisante sur les affaires ukrainiennes en général qu'à un préjugé par rapport à Kyiv. De plus, la structure générale du conflit politique en Ukraine a changé. Jusqu'en 2014, les confrontations locales opposaient surtout les clans d'oligarques qui utilisaient divers moyens de corruption sur les hommes politiques et les bureaucrates afin de s'approprier des ressources

The current economic, legal, and military instruments employed to support Ukraine are too weak to deter Russia from continuing to use its escalation potential. The Western sanctions regime is timid. The delivery of advanced defensive weaponry to Kyiv has remained a mere discussion. Initiatives to embed Ukraine within a serious international security structure are absent. As a result, the costs of new Russian interventions in Ukraine remain lower than the domestic political losses that the Kremlin will incur from a dynamically developing Ukrainian state. Only once this calculation for Moscow changes will Ukraine get a serious chance at becoming a “second Poland.”

Die westliche Fixierung auf die Regierungsqualität und weniger die Überlebenschancen des ukrainischen Staates ist überholt. Jetzt muss vor allem das durch den Krieg vergiftete Geschäftsklima verbessert werden. Was in der Ost- und Südukraine gebraucht wird, sind Garantien des Westens zur Sicherung in- und ausländischer Investitionen.

Нове німецьке дослідження «Die Ukraine in den Augen Deutschlands: Bilder und Wahrnehmungen eines Landes im Umbruch» (Kyiv: Buro fur politische Kommunikation, GIZ GMBH, 2018. 111 стор.) ретельно фіксує широкий спектр думок експертів ФРН щодо становища в Україні, його описи, сприйняття, розуміння і недостатнього розуміння в сьогоднішній Німеччині.

Продолжающиеся реформы и, как следствие, медленно возвращающийся экономический рост в Украине, демонстрируют первые эффекты от той помощи, что Запад оказывает Киеву. Тем не менее, пока проблема украинской безопасности остается нерешенной, частичные успехи в стабилизации Украины и возможные будущие социальные достижения в результате реформ могут оказаться пустыми. Скорее всего, Кремль будет делать все для того, чтобы предотвратить украинскую историю экономического и политического успеха.

Putin baut auf die dauerhafte Destabilisierung der Ukraine, um die Idee Neurussland lebendig zu halten. Doch kann die EU helfen, das Krisenland zu retten: Sie muss ausländische Investitionen schützen und Kiew einen EU-Beitritt in Aussicht stellen.

FDI guaranteed by western states and multilateral institutions would function as a protective mechanism for Ukraine. Publicly insured direct investments would create a close link between Western financial interests and future destabilizing activity by Russia that should have a calming influence on the Russian-Ukrainian conflict. More numerous Western assets and ventures located in Ukraine—particularly in the Russophone east and south—would create new interdependencies.

Взаємини із ЄС на даному етапі є визначальними для України у плані подолання корупції, утворення прозорих, сильних, ефективних політичних інститутів, яким би довіряло суспільство. Однак, незважаючи на підтримку України під час складних у її сучасній історії подій, ці взаємини все ж не можна назвати простими.

Pośród zmagań i podziałów rząd Poroszenki dokonał po cichumilowego kroku: Unia Europejska zastąpiła Federację Rosyjską napozycji największego partnera handlowego Ukrainy. […] Aby trafnieprognozować transformację Ukrainy po Majdanie, należy wpierwzrozumieć to, jak szerokie trendy w ukraińsko-europejskim handlupo 1991 r. stworzyły podstawy pod stopniowy zwrot w kierunku Europy.

A fundamental handicap of the current Western-supported reform drive in Ukraine is that its gradual success may be triggering increasingly aggressive counter-reactions from Moscow. That is because a more efficacious Ukrainian state is nothing less than an existential threat to the current power holders in Russia and Belarus, where people are interested in Ukrainian domestic affairs. Ukraine is on the right way, but – as long as Russia and Belarus do not start implementing deep reforms themselves – it will reform itself on an increasingly risky path. Putin, Lukashenko & Co. cannot afford to have next door a flowering Eastern Slavic future EU member state whose deep ties into Russian and Belarusian society will make the middle classes of their own unreformed countries’ envious.
