The Chaumié circular introduced the notion of « diminished responsibility » in 1905 in order to consider criminal defendants with mental retardations or psychic abnormalities. During the Fourth Republic (1947-1959), psychiatric examinations were almost always conducted in criminal cases, especially when the death penalty was at stake. It was then assumed that the mentally unbalanced and retarded criminals shouldn't be executed. However, a study of the pardon requests indicates that a « diminished responsibility » could not always prevent an execution. The president of the Republic had the right to pardon these criminals but it seems that the conclusions of psychiatric examinations influenced the decisions only to a limited extent.

E: What are the social forces behind capital punishment? In order to answer this question the author analyzes the long-term development of capital punishment in two countries: Austria and England between 1700 and 1918. Surprisingly, until the middle of 19th century there were much more people punished to death or executed in England than in Austria. This facts asks a riddle. Why there is a more severe penal code in the then liberal, industrialized, and higher developed England than in the authoritarian Austria with its almost thoroughly agrarian economy of that time?

Too much 'administrative history' is about the people at the top of the administration.
This paper talks about how we can look at the history of everyday life to study the transformation in values, structures, and institutions which constituted the rise of the modern state. Its topic is the way that policing was controlled, in social and technical terms, rather than those of political accountability.
At the end of the 18th century, the British constable was a self-employed artisan: by the end of the 19th century he had
been subsumed into one of the new police institutions. Though perversely labelled 'professionalisation', this process was more akin to 'proletarianisation' for those who underwent it. As well as close bodily discipline, police forces were early adopters of
rule-based hierarchy, interlocking networks of inspection, and of securing loyalty by consciously managing the careers of their employees.
Police forces also relied on the early adoption of electric telecommunications, and the pattern of this adoption reveals
much about information flows in 19th century police forces. Foucault may have been wrong about prisons, but he was right about police forces.

This article explores the discursive afterlife of the 1822 murder of Marie Gérin by the Abbé Mingrat, who subsequently fled France and was never extradited. The crime, which the Restoration government attempted to conceal, is read here as a cause célèbre that acted throughout the Restoration as a watchword of anticlerical and otherwise oppositional opinion. The article examines pamphlets published by Marie’s relatives and by Paul-Louis Courier, on the one hand, and on the other, official papers relating to the persecution of Marie’s brother for his attempts to publicize the crime. It takes these texts as symptomatic of a broader early nineteenth-century dispute: a cultural and moral disagreement about the meaning of scandal, which might be imagined ‘conservatively’, as a pathogenic spectacle that spreads corruption; or, as it was by the pamphleteers, ‘progressively’, as a therapeutic revelation that brings that corruption to an end. It also contributes to our understanding of the modes of political participation available to those excluded from the Restoration political process.
