Attorneys and Creators: On Oct. 7 from 1:30 p.m. to 3 p.m. ET, the IP Policy Institute at the University of Akron School of Law will host a free webinar on the 9th Circuit’s rehearing in “Sedlik v. Von Drachenberg.” The dispute involves photographer Jeff Sedlik who created an iconic portrait of Miles Davis and a tattoo artist known as Kat Von D who tattooed an image of the photo on a client’s arm. Topics that will be discussed during the webinar include the substantial similarity doctrine, how that test is applied, and whether it is being applied in a way that disadvantages copyright owners and creators. The panel will also discuss potential changes to the standard and how that might impact copyright litigation. The webinar speakers are William Patry, counsel for plaintiff-appellant Jeff Sedlik and author of Patry on Copyright; Professor Bruce Boyden, who filed an amicus brief in support of neither party; Professor Jessica Silbey, who filed an amicus brief supporting appellees and affirmance; Eleanor M. Lackman, Co-Chair of the Intellectual Property Practice Group at Mitchell Silberberg & Knupp LLP; and Professor Sandra Aistars, Distinguished Counselor in Residence and Professor of Law (as moderator).
